Defendant shall be punished by imprisonment for a term of one year and four months.

The evidence seized shall be forfeited from the criminal defendant.

Punishment of the crime

[criminal history] On October 16, 2015, the Defendant was sentenced to imprisonment with prison labor for a violation of the Narcotics Control Act at the Busan District Court on the grounds of a violation of the Act on the Control of Narcotics, etc., and six months in imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at the same court on June 24, 2016, and six months in imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. at the Ulsan District Court on October 13, 2016 and completed the execution of the sentence at the Daegu District Court on April 26, 2017.

[2] Notwithstanding the fact that the Defendant is not a narcotics handler, the Defendant dealt with the Megatop clop (one philopon; hereinafter “philopon”) which is a local mental medicine as follows.

1. On March 27, 2018, the Defendant purchased penphones with approximately KRW 200,000 and approximately 0.3 g of Handphones, which were parked on the offline of Da in Busan Southern-gu, Busan-gu, between around 21:0 to 22:00,000.

2. Medication of phiphones.

A. On March 27, 2018, the Defendant administered philophones by inserting approximately 0.1g of philophones into a single-use injection machine in the Defendant’s vehicle parked near Busan Southern-gu, and diversing them by dilution with raw water.

B. On March 28, 2018, at around 01:00, the Defendant administered philophones by inserting the volume of philophones into a one-time injection machine at the Defendant’s office located in Nam-gu Busan Metropolitan City G, and dilution with vegetable water and inserting them into the vegetable.
