A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On November 17, 2008, the Defendant, at around 16:00 on November 2, 2008, displayed the orders of the traders in the “D” office operated by the Defendant under the ground of 101 in the Gangnam-gu Seoul Metropolitan City Cbuilding, and “in Korea, it is necessary to operate the precious metal tax public office, and the funds are required to supply the precious metal containing the text. When lending KRW 30 million, the monthly interest shall be paid in 60,000,000 and the monthly interest shall be paid by April 17, 2009, which is five months after the date of payment. However, in fact, since the financial institution debts worth approximately KRW 50 million at the time and the amount of delinquent tax equivalent to approximately KRW 40 million have deteriorated to the extent that it is impossible to normally operate the three public hall, the defendant was unlikely to repay interest and principal as promised by the victim, and precious metals in the factory were owned by the trader and could not be repaid to the victim as a substitute.
The Defendant, by deceiving the victim, received KRW 27 million from the victim’s bank account (Account Number:F) in the name of the Defendant, after deducting the amount of KRW 3 million from the prior interest on the 17th day of the same month.
2. However, the defendant could not operate a factory to the extent that he could not pay his wages properly due to the aggravation of the financial circumstances, and the defendant would bring 600 money into Korea at the beginning of 2010.
