1. The Defendant’s KRW 303,702,815 as well as the Plaintiff’s annual rate from April 6, 2010 to March 28, 2014.

Basic Facts

The status-based foundation B (hereinafter “B”) is a non-profit foundation established to facilitate the export of venture businesses and small and medium enterprises and to support their overseas expansion, etc., and is a subsidiary that receives subsidies from the Administrator of the Small and Medium Business Administration pursuant to the former Act on the Budgeting and Management of Subsidies (amended by Act No. 10898, Jul. 25, 2011; hereinafter “Act”), and is a person who was in the position of the president of B.

B, including subsidies and orders to return subsidies in 2008, filed an application with the Administrator of the Small and Medium Business Administration for approval of the “C Project” (hereinafter the “Project”). On September 19, 2008, the approval of the Project was granted by the Administrator of the Small and Medium Business Administration along with the detailed implementation plan of the Project. The total budget required under the above detailed implementation plan is KRW 772,00,000, and the budget required for each item is as follows:

Services Costs: 150,000,000 for software development - Costs of 50,000,000 for software development - Costs of 100,000,000 for data base: Costs of equipment: KRW 572,00,000 for software: KRW 242,000 for the software sector - KRW 280,000 for the server sector - Network sector: KRW 50,000 for the information strategy planning cost of KRW 50,000 for the network sector: KRW 50,000 for the efficient progress of the project of this case; and as a result, on October 30, 2008, the Administrator of the Small and Medium Business Administration requested the Administrator of the Small and Medium Business Administration to revise the subsidy budget of this case for the purpose of efficient implementation of the project of this case.

On the other hand, B requested the Korea Economic Research Institute, a foundation, to provide the cost accounting service of the instant project on September 22, 2008. As the total cost of the instant project was estimated to be KRW 924,00,000 (the development service cost of KRW 352,00,000,000, and the equipment cost of KRW 572,00,000,000), B requested the Seoul Local Public Procurement Service to make a bid contract of the instant project on September 22, 2008.

The Seoul Local Public Procurement Service shall execute the instant projects.
