A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant and the victim D(the age of 26) came to know through the “E” of the past mobile phone-comting case.
1. The Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (i.e., cameras, etc.) from Oct. 1, 2013 to Nov. 201, 2013, in the Defendant’s residence where the Defendant was in Japan-dong, U.S. F apartment of 204 Dong-dong, U.S., U.S. and U.S. (1302), taken photographs of the Defendant’s cell phone of the victim’s body using the cell camera function at his own discretion.
Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using a mechanical device with a camera function against his will.
2.
