The judgment of the court below is reversed.

Defendants shall be punished by a fine of 1.5 million won.

1. The summary of the grounds of appeal is that the Defendants’ act interfere with the solicitation of members of the victim by spreading false facts in light of the background leading up to the instant crime, the contents of the newsletter distributed by the Defendants, and the general meaning of the word “the fraudulent sale”.

2. The summary of the facts charged is that Defendant A is the president of a partial association that promotes redevelopment in the area of local house development in Ansan-gu, Seoul-gu, and Defendant B is the head of D Co., Ltd., the agent of the said partial association.

The above redevelopment area is not determined by the specific rebuilding promotion committee, and two parts of the partnership are selected separately from each other to carry out the affairs such as the recruitment of members, and the victim E is the agent of another part of the partnership in competition with the defendants.

Although the defendants were well aware that the victim company did not unlawfully establish a public relations center for sale in lots and did not sell in lots, the defendants knew that the competitor company did not sell in lots, thereby spreading false facts to the victim company, thereby inducing the victim company to withdraw from the cooperative association members in the agency company.

According to the above conspiracys, the Defendants were guilty of the sales promotion office written in E for the unspecified majority of the members of the area redevelopment in Ansan-gu, Seoul during the period of September 2016.

As the sales promotion office established in E around November 3, 2016 is entirely unrelated to G apartment, H-affiliated, and redevelopment, the sales promotion office’s distribution of the newsletter containing the false contents of “G apartment and H-affiliated resident,” the sales promotion office is deemed to have caused damage to the sales of fraud - G apartment and H-affiliated resident’s one with multiple members.
