1. All appeals filed against the Plaintiff (Counterclaim Plaintiff) and against the Defendant (Counterclaim Plaintiff)’s counterclaim.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. The Plaintiff is the owner of the 3,718 square meters and E factory site in Gwangju-si, Gwangju-si, and 5,500 square meters (hereinafter “Plaintiff-owned land”), and around 2001, the Plaintiff newly constructed a factory on the Plaintiff’s land (which was completed around 2005) and obtained permission to occupy and use the 1,458 square meters in neighboring F, G, and H land owned by the Plaintiff (hereinafter “the land occupied and used in this case”) from the Gwangju City Mayor for the purpose of using it as a factory site entry, and the road packaging work for the land occupied and used in this case.
나. 피고 B은 I, J, K, L, M, N, O, P 토지를 소유하던 중 위 각 토지의 개발을 위하여 원고에게 이 사건 점용토지의 사용승낙을 요청하여 2009. 9. 16. 원고로부터 아래와 같은 내용의 도로사용승낙서(이하 ‘이 사건 승낙서’라고도로사용승낙서 ▣ 토지 소재지 : E 외 1필지 ▣ 사용승낙면적 : 상기 토지의 소유자로써 각종 관련법 규정에 의한 인ㆍ허가 시 피고 B이 진입도로로 사용함에 있어 사용을 승낙하며, 또한 본 승낙에 의하여 인허가 처리된 이전 이후라도 제3자(불특정 다수인)가 별도의 사용승낙 없이 진ㆍ출입도로로 사용(인ㆍ허가 포함)하여도 민ㆍ형사상 이의를 제기하지 아니할 것을 인감증명 첨부 확약합니다. 2009년 9월 16일 한다)를 교부받았다.
C. Defendant B paid KRW 37,500,000 to the Plaintiff on the day of receipt of the instant written consent, and Defendant B received from the Plaintiff a receipt (hereinafter “instant receipt”) stating that “I, as the land owner (the Plaintiff) of the said I and seven parcels of land, would receive the said amount at the cost agreed to be used as the road when Defendant B applied for permission for the factory site, warehouse, or any other purpose, as the land owner of the said I and seven parcels of land.”
