피고인은 2014. 7. 1. 07:41 경 불 상의 장소에서, 직장 동료로 알고 지내던 피해자 B와 연락이 되지 않자 피고인의 휴대전화를 이용하여 피해자의 휴대전화로 ‘ 너 쥑인다’ 라는 내용의 문자 메시지를 전송하는 등 별지 범죄 일람표 기재와 같이 2014. 7. 1. 경부터 2014. 7. 4. 경까지 불상의 장소에서 위와 같은 방법으로 피해자에게 총 59회에 걸쳐 문자 메시지를 전송함으로써 피해자를 협박하였다.
