A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. The Defendant violated the Act on Special Cases concerning the Regulation and Punishment of Speculative Acts, etc. was a person who installed 24 units of “F” in the Gangnam-gu Seoul and underground floors and operated a game room in the trade name of “F”, “G” is an employee employed by the above Defendant as the head of the bar office, and H is the Defendant’s friendship and employee of the above game room.

Although anyone is prohibited from engaging in speculative business by using slot machines or speculative gaming machines, other than the speculative business under the provisions of any Act, he/she is prohibited from engaging in speculative business, the Defendant, along with G and H, and from April 25, 2016 to May 4, 2016, installed 24 game machine "Yamato" in the above game site, which is a speculative gaming machine, in the above game site, and received cash from many unspecified customers, and paid a card with the same amount of points charged to the customers, and then the customers receive the points charged to the card registration for the game machine using the above card, and then, they operated the game in such a way as to exchange the remaining points in cash to the customers requesting exchange after completing the game.

Accordingly, the defendant, in collusion with G and H, engaged in speculative activities that cause property benefits or losses to customers according to the outcome of a game by using a massage game machine, which is a speculative entertainment device.

2. On May 4, 2016, at around 16:55, the Defendant: (a) heard the fact that the Defendant’s “F” Kaka Pa Pac operated by the police from customers in the game room; (b) was punished as the fact that the game room was operated; (c) the Defendant had the employees of the said game room receive punishment; and (d) asked G to “G to make a false statement by having the Defendant operate the game room on behalf of the Defendant; and (d) using a cellular phone, “Nactor is called as the owner of the game room,” and the said G around 19:10 on May 4, 2016.
