A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 16, 2006, at around 03:25, the Defendant tried to pay money to the victim who had sexual desire while drinking mixedly within the “E” main point of the victim D (n, 48 years of age) in Gangseo-si, Gangnam-si (E).

In spite of the demand of the defendant throughout several times, the defendant has taken mind to rape the victim who did not take advantage of the defendant's demand.

피고인은 피해자의 주점에 피고인과 피해자 이외에 다른 사람들이 없는 것을 확인하고 피해자를 손으로 밀어 소파 위로 넘어뜨린 다음 피해자의 몸 위에서 한 손으로는 피해자의 가슴을 눌러 피해자가 꼼짝하지 못하게 하고 다른 한 손은 피해자의 팬티 속으로 집어넣어 손가락으로 피해자의 음부를 수 회 만진 다음 피고인의 바지를 벗으려고 하였으나 피해자가 피고인의 바지를 붙잡고 발버둥을 치며 비명을 지르는 바람에 범행이 발각될 것이 두려워 도주하였고, 그 과정에서 피해자에게 치료일수 미상의 좌측 허벅지 윗부분 찰과상 등의 상해를 입게 하였다.

Accordingly, the defendant did not commit rape, but did not commit an attempted rape, and thereby suffered injury to the victim.
