The plaintiffs' claims are dismissed.

Basic Facts

Plaintiff

A, B, C, and Non-Party Network G (hereinafter “instant owner”) decided to remove Gu houses on the land and newly construct neighborhood and multi-household houses around May 2010, as owners of Yongsan-gu Seoul Metropolitan Government I, J, and K, such as the attached list.

(2) On May 21, 2010, the instant owner entered into a contract on the instant construction project (hereinafter “instant contract”) with the Defendant, setting the rate of liquidated damages from May 27, 2010 to December 30, 2010, setting the construction period of KRW 139,2150,000 as KRW 1/1,00 per day, and the instant contract on the instant construction project (hereinafter “instant contract”).

The net G is deceased on May 24, 2013 and there is Plaintiff E and Plaintiff F, a spouse, who is the heir.

[Grounds for recognition] The plaintiffs' assertion on the plaintiffs' claim for the purport of Gap's evidence Nos. 1 and 2, and the whole pleadings commenced on May 27, 2010, the construction of this case was suspended on or around July 2010 and the subcontract price was not paid to subcontractors due to the current representative L and former representative director M's dispute, aggravation of financial standing, etc. The building owner of this case newly selected non-party Y Co., Ltd. as Si Y on April 3, 2012 and started the construction of this case. The defendant is obligated to pay compensation for delay to the plaintiffs from December 31, 2010, the following day after the completion date of the construction of this case, until April 2, 2012 x 637,593,250 won (the construction amount, 1,392, 125, 000 won x 10/480) x 50 days interest rate).

Judgment

In full view of the overall purport of each entry and pleading in Eul evidence Nos. 1 through 6 (including paper numbers), the owner of the instant building shall, when the instant construction was delayed due to the financial problem, enter into a new contract for the instant construction and the construction project with the non-party corporation on October 21, 2010.
