Defendant shall be punished by a fine of KRW 10,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. The defrauded: (a) served as an insurance business employee of HSBC life insurance company; (b) concluded an insurance contract in the name of a person, including himself/herself and his/her family, who has no intent to conclude or maintain the insurance contract; and (c) received fees, etc. by paying part of the insurance premium.

On August 26, 2011, the Defendant: (a) prepared an insurance contract at the Busan Branch Office of the Victim in the 17th floor of Busan Metropolitan City, Busan Metropolitan City, as if he/she maintained the contract duration; and (b) submitted it to the Victim; (c) received KRW 2,511,360 for six months’ premiums from the Victim; and (d) received KRW 3,803,468 for fees from the Victim; and (e) received KRW 38,705,949 in total from the Victim in the same manner as shown in the List of Crimes (1) from December 2011 through December 11.

Accordingly, the defendant was given property to the victim by deceiving the victim.

2. No person who violates the Insurance Business Act shall provide a policyholder or the insured or promise to provide a policyholder or the insured with special benefits in connection with the conclusion or solicitation thereof;

On December 29, 2011, when the Defendant entered into an insurance contract called D and D, the policyholder, which is a social life insurance, the Defendant paid 497,800 won to the insurance company. From that time to January 31, 2012, the Defendant provided three policyholders with special benefits by paying 2,006,60 won in total of the premiums to be paid to the insurance company.
