The defendant shall be innocent.
Reasons
1. On May 12, 2014, the Defendant, at around 20:07, committed assaulting victims by putting the victim C(the age of 16)’s left knife at one time on the floor of hand, who had been seated adjacent to a water unit without any reason under the influence of alcohol, on the way ahead of the 750 gold basin in Gunpo-si, Mapo-si, Mapo-si, Mapo-si, Mapo-si, Mapo-si. On the other hand, the Defendant assaulted victims by putting the victim’s left knife (the age of 17) two times on the floor of hand
2. Determination
A. The Defendant asserts that he did not assault C and D from the police to this court.
B. Each legal statement of C and D and each written statement of C and D are written as evidence that seems to correspond to the facts charged in the instant case.
The written statement in C was written to the effect that “the defendant was dead at the left side of C,” and C was present as a witness in this court and stated to the effect that “A was present at this court to the effect that “A was seated by C, the defendant was 1st head with his hand and was unable to assault D.”
On the other hand, the written statement of D contains the content that "the defendant was at the time of two times the left side of D," and D appears as a witness in this court and stated that "A was at the time of 3,4 times the defendant's face and her face," and answer to the prosecutor's examination that "A victim C, a witness, who is at the time of his/her witness, assaulted the defendant C, who was the victim of the victim, who was at the time of his/her speechd the victim C," and thereafter, the prosecutor's examination that "A was at the time of his/her testimony (D) and C," stating that "C first met."
① The respective statements of C and D regarding the physical part of the victim of the assault and the frequency of the assault are not consistent. ② In particular, D are not consistent with the first statement made by the Defendant to the effect that the Defendant used the first assault against C and D in relation to whom the Defendant used the first assault against C and D, and then the statement made by the Defendant to the effect that the Defendant used the first assault against C.
