1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The purpose of the Plaintiff is to carry out real estate sale and solicitation of members, real estate sale and rental management business, and the Defendant’s real estate development and implementation business, and real estate sale and rental management business.

B. On January 23, 2017, the Defendant entered into an agency contract with the committee for promotion of D Association members to vicariously carry out the business of promoting new construction projects for apartments of a regional housing association (hereinafter “instant project”) on the land of 54,475 square meters in Seoul, Dongjak-gu Seoul Metropolitan Government (hereinafter “instant project”). The Defendant was paid KRW 20 million per one prop member (including value-added tax) and KRW 30 million per general local member (excluding value-added tax).

C. On May 1, 2017, the Defendant: (a) provided support to the Defendant, the Plaintiff: (b) performed the instant project on behalf of the Plaintiff, including the promotion of the establishment of a regional housing association; (c) support for the establishment of a regional housing association; (d) support for the selection of a contractor; and (e) support for the selection of a housing public relations corporation and a sales agent; and (c) entered into a new project of an association apartment with the Plaintiff to pay KRW 5 million for each household recruited members (including value-added tax); and

(hereinafter “instant agency contract”). D.

The main contents of the instant agency contract are as follows:

(2) The term “A” refers to “A” and “B”, the term “A” and “B”, under the contract with “B” and “B” for the successful recruitment and sale of members of the said subject matter, under which “A” is being promoted, enter into this contract for the purpose of smooth performance of duties by assisting “B”. Article 2 [2] of the contract shall assist “B” from May 1, 2017 to the time of authorization for the establishment of the association, in consultation with “A”.
