A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

To the extent that it seems that there is no concern about substantial disadvantage to the defendant's exercise of his/her defense right, part of the facts charged shall be amended.

1. On April 3, 2014, the Defendant: (a) around 03:30, the Defendant: (b) was under the influence of a police officer, who was dispatched to the 112 report by the victim E on the part of the first floor of the DD building in Ansan-si, and was frighting, and was under the influence of the police officer, who was sent to the 112 report, caused the damage by gathering a credit card settlement terminal on the victim’s possession, and caused the said amount to be broken.

2. 공무집행방해 피고인은 전항과 같은 일시경 같은 장소에서 재물손괴죄 및 위 업소 종업원 G에 대한 폭행죄로 현행범인 체포되어 같은 날 03:45경 경기안양동안경찰서 H파출소에 인치되자, 그곳에서 근무 중인 경찰관들에게 "개새끼들아, 파출소 이 순경새끼들아, 병신 같은 놈들아, 대머리에 머리나 심어라 개새끼들아, 씨발놈들, 미쳤나 돼지 같은 놈들"이라고 욕을 하는 등 행패를 부리다가, 앉아 있던 소파에서 일어나 파출소 접수대에 놓여 있던 경찰 모자를 집어 경찰관에게 던지고 삿대질을 하며 다가가 손으로 그의 가슴을 치려하였고, 이에 순경 I 등이 피고인을 제지하고 수갑을 채우려 하자 순경 I의 배를 발로 2회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers I on criminal investigation and civil petition affairs.
