A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

Around January 21, 2010 to January 20, 2013, the Defendant joined the NAF and retired from office as the head of the D Branch E branch office of the NAF from January 21, 2010 to January 20, 2013.

At the time of May 201, the Defendant: (a) at the time of annual salary around 130 million won (an annual salary of about 80 million won); (b) owned an apartment house equivalent to KRW 250 million at the market price; (c) however, the Defendant was liable for the total amount of KRW 320,983,006 to financial institutions, including apartment mortgage loans of KRW 122,983,00,00 in one bank; (d) on March 2010, the Defendant paid KRW 1420,00 won to the wife as monthly living expenses; (e) from around 2010 to around 2013, the Defendant was required to pay KRW 1420,000 as monthly living expenses; and (e) from around November 2010 to around 2013, there was no ability to repay money from the victim.

On the other hand, the Defendant came to know of the Victim F as the Nonghyup customer around 2003, and the victim got trusted by the Defendant, such as joining the Nonghyup’s financial product through the Defendant, and being in charge of the seal and passbook of the victim. From around 2006, the Defendant was fluorily used in brain color and was influorial memory, and was influorial surgery on February 2014, and was aware of the fact that the health condition is not good, and there was no intention to repay the same even if he borrowed money from the victim.

On May 17, 201, the Defendant concluded that at the NAD branch in Seo-gu, Seocheon-gu, Seocheon-gu, Seoul, the Defendant would make a false statement that, even if he/she borrowed money from the victim F, he/she did not have the ability or intent to repay the money, and that he/she would have used the money to use it for stock investment, etc., the Defendant would pay the money to the victim “I will lend the money by borrowing the money at once with the trust land as security, and will pay the money after one year.”
