및 B는 2012. 7. 19. 05:50경 목포시 C웨딩홀' 앞 도로에서 피해자 D(16세)이 오토바이를 타고 가다가 피고인 일행을 쳐다보았다는 이유로 B는 피해자에게 ”왜 꼰아봤냐”고 하며 손바닥으로 뺨을 수회 때리고 발로 성기 부위를 3 내지 4회 차고, 피고인은 노란색 우산으로 피해자의 얼굴, 팔, 허리 부위를 10회 정도 때렸다.
