Reasons

1. Basic facts

가. 피고는 주식회사 C(이하 ‘C’라고 한다)와 주식회사 D(이하 ‘D’라고 한다)의 대주주이자 회장 직함으로 위 각 회사 및 주식회사 E(이하 ‘E’라고 한다), 천안시 동남구 F에 있는 G점부터 H터미널까지의 상가에 위치한 ① I, ② J, ③ K, ④ L, ⑤ B(위 ①~⑤ 5개 사업장의 대표자는 피고이다), ⑥ M, ⑦ N, ⑧ O, ⑨ P(위 ⑥~⑨ 4개 사업장의 대표자는 피고의 장남인 N이다), ⑩ Q, ⑪ Q 공장(다만 위 공장은 다른 곳에 위치하고 있다), ⑫ R, ⑬ S(위 ⑩~⑬ 4개 사업장의 대표자는 피고의 차남인 T이다. 이하 위 ①~⑬ 13개 사업장을 ‘이 사건 개인사업장’이라고 한다)를 실질적으로 총괄하여 운영하고 있는 자이다.

B. On April 8, 1991, the Plaintiff joined as a member of the accounting division of C and retired on December 31, 2016, when he/she was on the part of C from January 1, 2003 to November 30, 201, and C’s director from December 1, 2010 to December 31, 201.

From October 1, 2010 to December 31, 2016, the Plaintiff concurrently held D’s directors and auditors from March 23, 2002 to December 31, 2016.

C. The Plaintiff, at the Defendant’s direction, performed C, D, and E’s audit duties, and performed accounting management duties of the instant individual workplace.

The Plaintiff received benefits from C. In 2016, the Plaintiff received total of KRW 148,958,340 as benefits, and was paid KRW 256,971,170 as retirement benefits on December 31, 2016.

The Plaintiff, upon the Defendant’s instruction that is the actual owner of the instant individual workplace, performed the work as the team leader who oversees and supervisess the work of the said 13 individual workplaces. The Plaintiff’s work provided to the instant individual workplace shall be deemed to have formed an implied employment contract relationship with the Defendant as an ordinary work.
