Reasons
1. Basic facts
A. The Defendant is a regional housing association that obtained authorization for the establishment of a housing association around April 12, 2016 with respect to a new apartment construction project in which G members of Kimhae-si as the project site.
B. The Plaintiff A, C, D, and E entered into an agreement with each housing association (hereinafter referred to as the “instant association joining agreement”) which intends to be supplied with one apartment unit after the completion of the said new apartment construction project (hereinafter referred to as the “promotion”), and the Defendant succeeded to the rights and obligations for promotion, and the Plaintiff B entered into the instant association joining agreement with the Defendant.
According to each contract, the Plaintiffs paid contributions, administrative service charges, etc. to the account of H Co., Ltd. designated by the Defendant.
The date of concluding the contract to join the association of this case and the payment details such as the contributions paid by the plaintiffs to the defendant are as listed in the following table (the plaintiff B, D, and E received each loan from the financial institution designated by the defendant for the payment of each contribution, and the defendant paid the above plaintiffs' loan interest interest rate on behalf of the plaintiff B and E from the execution date of each loan of this case until June 2018).
