A defendant shall be punished by imprisonment for four months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the representative director of corporation D (former trade name: Co., Ltd. E) with the purpose of providing consulting services related to start-up, etc. in the subparagraph B center C of Gwangju Northern-gu.

In accordance with the Small and Medium Enterprises Promotion Act, etc., the Small and Medium Business Corporation annually carries out a project for consulting with small and medium enterprises in order to secure competitiveness for the sustainable growth of the growth period and refined enterprises. The name of the project for supporting the small and medium enterprises is largely divided into examination-linked support and consumer-choice support. Among them, consumer-choice support is subdivided into consultation for sustainable growth, consultation for start-up business, consultation for starting-up business, and support for the small and medium enterprises. The Small and Medium Business Corporation shall select small and medium enterprises that intend to receive consulting in accordance with certain requirements and enter into an agreement with support enterprises and consulting agencies, and shall check whether the project has been carried out and completion report prepared by consulting agencies as the result of consulting, and then shall pay the Government subsidy as project expenses to consulting agencies.

After consulting with the above consulting support project, the Defendant entered the work log for the consulting support project in the name of the consultant in the name of the consultant in the process of receiving the project cost, which was managed by the Small and Medium Business Corporation, into the consulting platform managed by the Small and Medium Business Corporation, and attempted to receive the project cost by submitting a report on the completion of the consulting support project.
