A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

피고인은 2015. 5. 9. 01:00경 양산시 C에 있는 피해자 D(41세)의 주거지 앞에서, 편집성 정신분열병, 알코올 중독, 기질성뇌증후군으로 사물을 변변할 능력이나 의사를 결정할 능력이 미약한 상태에서 아무런 이유 없이 피해자의 주거지 출입문 유리창을 깨뜨리는 등 소란을 피워 피해자로부터 시끄럽다는 항의를 받자 화가 나 바로 옆집인 피고인의 주거지에서 위험한 물건인 부엌칼 1개(칼날길이 약 20cm, 총길이 약 32cm)를 들고 나와 손에 쥐고 피해자를 향해 “죽인다”고 말하며 피해자를 찌를 듯이 겨누고, 이에 피해자가 인근 덕계상설시장까지 200미터가량 도망갔으나 위 부엌칼을 손에 쥐고 뒤쫓아 가 계속하여 “죽인다”고 하며 칼을 쥔 손으로 피해자의 배 부위를 겨누고 찌를 듯이 행동하는 등 약 40분간 피해자를 위협하였다.
