1. The real estate listed in the separate sheet shall be put up for auction and proceeds therefrom.
Reasons
1. Claim for partition of co-owned property
A. As to the share of 3/13 in the name of the defendant B due to the reason of the "Succession on March 22, 2006, No. 7632," as to each of the real estate listed in the separate sheet of recognition (hereinafter "each of the real estate in this case"), the ownership transfer registration for each of the two-thirds/13 shares in the name of the non-party J and the network K and the defendant C, D, and E has been completed. The subsequent procedure for compulsory auction was commenced for each of the real estate listed in the separate sheet 1 through 3 in the title E among the real estate in this case and the above procedure was completed on May 16, 2014, the defendant F paid in full the sale price for each of the above real estate in his name and completed the registration of ownership transfer on July 2, 2014, and on each of the real estate in this case's name, the plaintiff was deemed to have completed the registration of ownership transfer from his own auction procedure to 2/13, 2014.
B. According to the above facts of recognition, the Plaintiff, a co-owner of each real estate of this case, may file a claim against the Defendants, who are other co-owners, for the partition of each real estate of this case, under Article 269(1) of the Civil Act.
2. The following circumstances are acknowledged to show the purport of the entire pleadings in the manner of dividing the jointly owned property Gap's evidence Nos. 1 through 7. In other words, each real estate of this case is divided in kind according to the shares of the plaintiff and the defendants, because the category of the land of this case is a answer or a pre-division, the area to be acquired after the division is narrow so that the plaintiff and the defendants can have less economic value and value to the plaintiff and the defendants. The plaintiff is divided in kind in the geographical location and surrounding circumstances.
