1. Defendant A shall be punished by imprisonment for six months.

However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Defendant A

A. The Defendant is a person who is engaged in driving of the CPoter-II trucking vehicle.

On July 9, 2017, the Defendant driven the above cargo while under the influence of alcohol 0.102% during blood transfusion around 06:00, while driving the said cargo at a level of alcohol 0.10%, the Defendant stopped the intersection in front of the oil station located in Gwangju City D from the side of Sungnam to Gwangju, along one lane between the two lanes.

At this point, there was a duty of care to prevent accidents in advance by accurately manipulating the brakes so as to prevent motor vehicles from getting off on the lickway to those engaged in driving of the motor vehicle.

Nevertheless, the Defendant neglected to do so, and caused the fall off from the brakes in the signal signal atmosphere, and caused the Defendant’s back-to-side loss of the vehicle, which was driven by the Victim F (Age 22) who was in front of the Defendant’s cargo vehicle, due to the Defendant’s failure to do so, shocked the front part of the G EXE car, into the part on which the Defendant loaded the cargo after the Defendant’s cargo vehicle.

Ultimately, the Defendant driven a motor vehicle in a state where normal driving is difficult due to the influence of drinking, and suffered injury to the victim H (the age of 22 years) who is the victim F and the victim H (the age of 22) who is the passenger of the damaged vehicle, for about two weeks, such as base salt, tension, etc.

B. The Defendant violated the Road Traffic Act (drinking) driving the said Poter II truck at a section of about 5km from the other party dong in Seongbuk-gu in Sungnam-si to the E stations in Gwangju-si, in the state of alcohol by 0.102% during the day-to-day alcohol level under paragraph (1).

2. On July 9, 2017, the Defendant was under the influence of alcohol content of 0.189% in blood around 06:00, Defendant B, from the vicinity of the members tunnel to the roads front of the oil station located in Sungnam-gu, Jungwon-gu, Sungnam-gu, Seoul, to the level of about 5km in front of the oil station located in Gwangju-si.
