1. The Defendant shall pay to the Plaintiff KRW 10,170,432 and the interest rate of KRW 20% per annum from November 16, 2014 to the day of full payment.

1. Facts of recognition;

A. From November 19, 2012 to November 1, 2014, the Plaintiff was employed by and served for the Defendant. At the time of retirement, the Plaintiff was not paid KRW 22,63,472 in total of KRW 6,30,00 and retirement allowances of KRW 16,33,472 from August 19, 2014 to October 2014.

B. On February 2015, the Plaintiff received substitute payment of KRW 12,463,040 from the Korea Labor Welfare Corporation after filing the instant lawsuit.

According to the above facts of determination, the Defendant is obligated to pay to the Plaintiff the amount of 10,170,432 won of the unpaid wage and retirement allowance balance, and damages for delay calculated at the rate of 20% per annum from November 16, 2014 to the date of full payment as stipulated by the Labor Standards Act.

3. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim is accepted on the same ground as the conclusion.
