Reasons
1. Basic facts
A. The Korea Housing Corporation of this case (hereinafter “Korea Housing Corporation”) planned the construction and sale of apartment (hereinafter “the apartment project of this case”) that includes C apartment 201 Dong 705 (hereinafter “the apartment project of this case”) in Gangseo-gu, Busan, etc., and entered into a business agreement and loan agreement (hereinafter “the instant business agreement and loan agreement”) with the lender of the company (hereinafter “the lender”) who was represented by the Defendant National Bank (hereinafter “Defendant National Bank”) with the Defendant National Bank (hereinafter “Defendant National Bank”) on November 24, 2005. The main contents of the instant business agreement are as follows.
The object unsold in lots under Article 6 (2) of the Business Agreement: The security trust or disposal trust provided to a trust company designated by the lender with the lender as the first priority beneficiary and the trustee designated by the lender, and the certificate of such right to benefit is provided under Article 7 (2) of the Business Agreement.
(a) Effectives and the City Treasury shall establish a “account for Payment of Sale Price” in the name of Effectives with the Bank to receive the sale price (including contract money, intermediate payment and balance) in accordance with the terms and conditions of the contract for sale within the period of this Agreement from the buyers;
(b) The executor shall designate the sales contract form as the account for the payment of the sales proceeds so that the buyer may deposit all the sales proceeds into the account for the receipt of the sales proceeds, and shall not allow deposit into the account for the receipt of the sales proceeds, and shall specify the purport that the payment of any sales proceeds which is not paid by the account for the receipt of the sales proceeds, such as deposit into the other account, the sales contract form, the advertisement for the sales, etc., is invalid.
