1. 피고인 A 피고인 A는 2012. 9. 9. 04:10경 부산 동래구 E에 있는 ‘F포장센타’ 내에서, 화장실에 가던 중 피해자 B(남, 52세)과 눈이 마주쳤다는 이유로 손바닥으로 가슴을 2회 밀치고, 뺨을 2회 때리고, 멱살을 잡아 밀고 당기며 넘어뜨린 후 뒹굴고, 계속하여 피고인 A는 위 포장센타 6번 코너주 피해자 G(여, 56세)에게 아무런 이유 없이 “야 씹할년아”라는 등 욕설을 하며 주먹으로 얼굴을 수 회 때려, 피해자 B에게 치료일수 미상의 왼쪽 어깨와 팔꿈치 부위에 찰과상을, 피해자 G에게 치료일수 미상의 코 등 부위가 약 1센티 가량 찢어지게 하는 상해를 가하였다.

2. 피고인 B 피고인 B은 제1항과 같은 일시 및 장소에서, 피해자 A로부터 폭행을 당하자 위 피해자의 멱살을 잡아 밀고 당기며 넘어뜨린 후 뒹굴면서 발로 차는 등 때려 피해자에게 치료일수 미상의 턱과 목, 가슴 등에 대한 찰과상을 가하였다.
