The plaintiff's claim against the defendants is dismissed in entirety.
Litigation costs shall be borne by the plaintiff.
Reasons
1. Basic facts
A. Relevant Party A Co., Ltd. (hereinafter “A”)
(2) On December 28, 2012, the Korea Deposit Insurance Corporation was declared bankrupt on July 1, 2013 by the Financial Services Commission as a juristic person established under the Mutual Savings and Finance Company Act for the purposes of credit fraternity business, credit installment savings business, receipt of deposits and installment savings, loan business, etc., and was declared bankrupt on July 1, 2013 by the Seoul Central District Court. The Korea Deposit Insurance Corporation was appointed as A’s trustee in bankruptcy from February 7, 2004 to September 10, 2007.
B. From January 21, 2013 to April 26, 2013, the Korea Deposit Insurance Corporation conducted an investigation into the non-performing loan in violation of the Mutual Savings Banks Act and the standard loan regulations for mutual savings banks with respect to A, and its related persons. 2) The Korea Deposit Insurance Corporation concluded a loan of KRW 7 billion to E on June 30, 2006 for the non-performing Co., Ltd. (hereinafter “SP”) (hereinafter “SP”), a loan of KRW 4.8 billion on October 27, 2006, a loan of KRW 4.7 billion on new industry development (hereinafter “new industry development”), a loan of KRW 6 billion on April 21, 2013, and a loan of KRW 2006 to E (hereinafter “SP”) 1.7 billion on April 20, 2006, and a loan of KRW 205.7 billion on each of the instant loans to EPP (hereinafter “SPP”).
C. On November 27, 2012, E, including the transfer of ownership to the Defendants, made a promise to terminate title trust with respect to each real estate listed in the separate sheet No. 1 and No. 4, and completed the registration of title transfer claim under the name of the Defendant’s text as the receipt of the title transfer claim registration office in the Changwon District Court’s title on December 6, 2012.
In addition, E is each real estate listed in the attached Table 2 to 8 and attached Table 1 with the defendant's door on December 21, 2012.
