1. The defendant shall be punished by imprisonment for one year;

Punishment of the crime

1. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) by the Defendant is a person engaged in driving B K5 cars.

On March 6, 2020, the Defendant driven the above vehicle under the influence of alcohol of 0.198% with blood alcohol concentration of 0.198% on March 6, 2020, and driven the long-term underground vehicle in Kimpo-si 1406-4, Kimpo-si toward strengthening from the side of Seoul.

In such cases, a person engaged in driving of a motor vehicle shall not drive a motor vehicle while under the influence of alcohol, and shall accurately operate the steering direction, brakes, and other devices of the motor vehicle, shall not drive a motor vehicle at a speed or in such a manner as to inflict any danger and injury on others according to the road traffic situation and the structure and performance of the motor vehicle, and there was a duty of due care to make the traffic situation well reported and safely to prevent accidents in advance.

Nevertheless, the Defendant, while neglecting the influence of alcohol, did not discover the victim C (the 28-year-old) driver car in front of the direction of the Defendant’s proceeding, and did not see the victim C (the 28-year-old) driver car and was able to drive the damaged vehicle in front of the Defendant’s vehicle.

Ultimately, the Defendant suffered injury, such as salt pans and shoulder pansiums, which require approximately two weeks of care by occupational negligence as above.

2. On March 6, 2020, at around 21:45, the Defendant driven a BK5 vehicle under the influence of alcohol content of 0.198% at a section of approximately 2km from the front of the site of apartment construction in Kimpo-si, Kimpo-si to the long-term underground streets located in 1406-4, Kimpo-si, Kimpo-si, Kimpo-si.
