1. Defendant A shall be punished by imprisonment with prison labor for one year;

1. Defendant A

A. On November 3, 2015, Defendant A issued a summary order of KRW 100,000 as a fine for a violation of the Road Traffic Act (driving) at the Busan District Court on December 23, 2015; and KRW 5 million as a fine for a violation of the Road Traffic Act (driving without a license) at the Busan District Court on December 23, 2015; around 06:10 on July 8, 2018, Defendant A driven a G Kanop vehicle (hereinafter referred to as “instant vehicle”) under the influence of alcohol concentration of approximately 0.150% from the 783 meters portion of alcohol to the roads located in the Busan Summer-gu (hereinafter referred to as “instant vehicle”).

B. On July 9, 2018, at around 21:23, 2018, Defendant A instigated the Defendant A who committed a crime corresponding to a fine or heavier punishment by allowing the instant driver to make a false statement to the police officer at the transportation investigation department office of Busan Summer Police Station around July 14, 2018.

2. On July 14, 2018, Defendant B made a false statement to the police officer in charge that “A was involved in an accident while driving the instant vehicle on or around July 8, 2018, even though the Defendant did not drive the instant vehicle at the 655 Sloping Police Station guards and the transportation investigation team office, Defendant B, who committed a crime corresponding to a fine or heavier punishment,” thereby allowing the police officer in charge to escape.

1. On October 16, 2018, Defendant A was driving the instant vehicle without obtaining a driver’s license in front of the cafeteria of the “I” restaurant located in the J of the Jinhae-si, Changwon-si around 02:23, October 16, 2018.

2. Violation of the Road Traffic Act (Refusal of measurement) by Defendant A shall be dated 2018.
