1. The Defendant: (a) KRW 512,481,00 for the Plaintiff and the Plaintiff’s KRW 5% per annum from June 13, 2016 to May 12, 2017; and (b) May 2017.

Facts of recognition

A. The Defendant is a company for the purpose of theater operation and management, real estate development business, etc., and is the seller of the instant building D with the land of 1933m2 in Busan-gun, Busan-gun (hereinafter “instant building”).

B. On March 9, 2016, the Plaintiff concluded a sales contract to sell the fourth floor E (hereinafter “instant store”) of the instant building that was constructed at the time from the Defendant (hereinafter “instant sales contract”) in the unit price of KRW 1.6 billion (excluding surtax) (hereinafter “instant sales contract”).

Some contents of the instant sales contract are as follows.

The scheduled date of saleroom occupants: (a) Article 1 (unit sale price: 1,60,00,000 of the unit sale price of the land in lots: 517,300,000,000 1,782,700,700: 1,708,270,000 of the unit sale price of the land: The aggregate of the payment time of KRW 1,708,270,000 and the value-added tax (including VAT deposit) (including 10%) on March 9, 2016; (b) the transfer registration of the above 30,00,827,000,827,000,0000 pro rata; (c) the transfer registration of the ownership shall be 1,60,000,0000,00000,0000,201,201,6304,616,206,2016,64,206

Matters of special agreement

1. “Buyer” will pay “Buyer” the rate of return on 4% per annum on the sales amount (excluding value-added tax) for one year after the date of transfer of ownership by 12 months in installments.

C. Pursuant to the instant sales contract, the Plaintiff paid KRW 170,827,00 as down payment (including value added tax) to the Defendant around March 4, 2016 and around March 9, 2016, pursuant to the instant sales contract, and paid KRW 341,654 as the first intermediate payment around June 13, 2016.
