1. The summary of the grounds for appeal (e.g., imprisonment with prison labor) of the lower court is too uneased and unreasonable.

2. In light of the motive, means and result of the instant crime, the circumstances after the crime, the fact that a motor vehicle driven by the Defendant was covered by comprehensive insurance, the age, character and conduct, environment, and criminal records as shown in the arguments, the lower court’s sentence against the Defendant is too unjustifiable, and thus, the prosecutor’s above assertion is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
