1. The Defendant shall pay to the Plaintiff KRW 94,915,39 and the interest rate of KRW 15% per annum from April 18, 2017 to the date of complete payment.

1. Basic facts

A. The Plaintiff and the non-party B Co., Ltd. (hereinafter “non-party Co., Ltd.”) have continued to engage in the growing process of clothing and related mechanical lease transactions since 2012 as a Vietnamese.

B. On May 27, 2014, the Plaintiff drafted a written agreement for debt repayment (hereinafter “instant agreement”) with the non-party company as follows, and the Defendant jointly and severally guaranteed the non-party company’s obligations under the said agreement.

1. On November 30, 2013, the Plaintiff and Nonparty Company reaffirmed the repayment plan as amended with respect to the repayment plan agreed upon on November 30, 2013.

2. As to this case, the non-party company should prepare in advance materials available to transfer them to the Plaintiff.

3. The non-party company sets up a security (the ownership of the non-party company is a special agreement) for obligations under this plan for the assets owned by the non-party company.

4. The joint and several sureties shall provide a joint and several surety with respect to this reimbursement plan, bear all the same obligation as the non-party company, and confirm that he has no right of defense for highest and search.

5. The non-party company shall accurately deposit the funds at the 25th day of each month according to the repayment schedule.

6. The non-party company shall transfer its ownership to the Plaintiff according to a contract establishing a collateral with a special agreement for the transfer of ownership, even once a reimbursement is made, and the Plaintiff’s machinery kept in the non-party company pursuant to a mechanical sales contract (the entry of ownership) shall be immediately recovered.

No non-party company may raise an objection against it.
