Comprehensively taking account of the purport of the entire arguments in Gap evidence No. 1 (including additional numbers) as to the cause of the claim, it is recognized that the plaintiff loaned KRW 350,000,000 to the defendant on November 5, 2012 by setting the interest rate of KRW 1.43% per month and January 4, 2013. The plaintiff was paid KRW 81,40,219, and paid KRW 267,368,493 among them, 200,000,000,000 to the defendant on September 25, 2014 and appropriated the remainder of KRW 14,031,726 as interest. Thus, the defendant is obligated to pay the plaintiff the amount of KRW 350,00,000 to KRW 350,000,000 - KRW 267,368,493) from the following day of the lawsuit to the date of complete payment.

2. The defendant defense to the effect that on November 5, 2012, the defendant paid interest of KRW 10,000,000 to the plaintiff until January 4, 2013 as a prior interest. However, since there is no evidence to acknowledge this, the defendant's defense is without merit.
