1. On February 9, 2017, the Defendant’s disposition of non-approval for medical care rendered to the Plaintiff is revoked.

2. The costs of the lawsuit are assessed against the defendant.

Reasons

1. Details of the disposition;

A. The Plaintiff, at around 08:00 on January 17, 2017, was a person working as the head of the management law team at the non-party 1 corporation (hereinafter “the instant company”). Around 08:00, the Plaintiff suffered an injury in the field of a stable competition in which the Plaintiff participated at the relevant stable club (location omitted) in Songpa-gu (hereinafter “the instant stable competition”), and applied for medical care to the Defendant.

B. On February 9, 2017, the Defendant rendered a decision not to approve the Plaintiff’s application (hereinafter “instant disposition”) on the grounds that it is difficult to see the Plaintiff’s exercise of labor management or business operation according to social norms as necessary for labor management or business operation.

2. Whether the instant disposition is lawful

A. The plaintiff's assertion

The Rab-dong club to which the Plaintiff belongs is practically forced to join a meeting that the representative director actively hosts, and the Rab-dong games of this case are events against major customers, and the company of this case was formed as part of the business, such as supporting vehicles for participating employees.

Therefore, the defendant's disposition of this case which did not recognize the plaintiff's injury or disease suffered during the stable game of this case constitutes occupational accident is illegal.

B. Determination

1) In order for a worker to be recognized as an occupational accident when the worker was injured while performing a certain act, the process of such an act should be deemed to be under the control and management of the business owner, such as the worker’s act of performing his/her own duties or preparing or arranging his/her duties, the physiological act or necessary act which is deemed incidental to the worker’s social norms, or the act of participating in an event held in accordance with the employer’s instruction or hosting, the rules of employment, collective agreement, or other customary practices. Therefore, if the worker was injured while participating in an event or a meeting other than a company that is not prescribed as one which is not obligated to be ordinarily engaged in by the labor contract, it can be recognized as an occupational accident only when the overall process of such event or meeting was under the control or management of the employer, by taking into account all the circumstances such as the organizer, purpose, content, number of participants and the method of operation, burden of expenses, etc. of the event or meeting.

2) 이 사건에 관하여 보건대, 갑 제4, 6 내지 10호증(각 가지번호 포함)의 각 기재 및 증인 소외 2의 증언에 변론 전체의 취지를 종합하면, ① 이 사건 회사의 직원은 총 38명으로 그중 남성 직원이 32명인데, 부상을 입었거나 집에서 회사까지의 거리가 먼 경우 등의 사유를 제외한 나머지 23명의 남성 직원이 모두 축구동호회 회원인 사실, ② 이 사건 회사의 축구동호회는 회사의 팀웍과 친목을 도모하기 위하여 대표이사의 제안으로 설립되었고, 생겼다가 소멸한 다른 동호회와 달리 현재까지 계속 유지되고 있는 회사 내 유일한 동호회인 사실, ③ 동호회의 축구경기는 매주 화요일 오전 6시부터 8시까지 정기적으로 진행되고, 경기 종료 후 참석한 직원들이 사우나 및 식사를 한 후 함께 회사에 출근하는 사실, ④ 이 사건 회사의 대표이사는 축구동호회에 가입하여 매주 개최되는 경기에 참석하고, 회장의 직책을 맡는 등 적극적인 활동을 하고 있는 사실, ⑤ 또한 위 대표이사는 신입사원에게 축구동호회 가입을 권유하고, 축구동호회 단체 채팅방에 ‘불참자가 많다면 낭비다… 체력이 없어 의욕이 없는 자는 경쟁사회에서 결코 살아남을 수가 없습니다…’의 글을 남기면서 직원들로 하여금 축구경기에 참석할 것을 독려하기도 하는 사실, ⑥ 이 사건 회사는 2014년경 이전까지 축구동호회 활동에 필요한 제반 경비를 지원하였는데, 2014년경 회사 재정이 어려워지면서 동호회 회원들이 매월 회비를 걷어 필요한 비용을 충당하게 된 사실, ⑦ 이 사건 축구경기는 거래처를 상대로 이루어진 사실을 인정할 수 있는바, 위 인정 사실과 위 각 증거들에 비추어 알 수 있는 다음의 사정들, 즉 ㉮ 동호회 축구경기는 휴일이 아닌 평일 이른 아침에 이루어졌고, 축구경기를 한 후 축구동호회 회원들이 정해진 출근시간보다 늦게 회사에 도착하더라도 이 사건 회사가 지각처리를 하거나 특별히 이에 대하여 지적하지는 않았던바, 회사가 동호회 축구경기 참가를 통상적·관례적으로 인정한 것으로 보이는 점, ㉯ 이 사건 회사의 대표이사가 앞서 본 바와 같이 축구동호회 가입 및 축구경기의 참가를 독려하였기 때문에 회사 직원으로서는 사실상 이를 거부하기 어려웠을 것으로 보이는 점, ㉰ 동호회 축구경기의 상대방이 거래처인 경우가 대부분이어서 영업에 도움이 되는 효과를 기대할 수 있는 점, ㉱ 회원들이 매월 일정액의 회비를 부담하기는 하였으나, 대표이사나 이사 등 임원들이 일반 직원보다 회비를 더 많이 부담함으로써 축구회의 운영을 간접적으로 지원하였던 점 등에 비추어 보면, 이 사건 축구경기는 사회통념상 노무관리상 필요에 의하여 사업주가 실질적으로 주최하거나 관행적으로 개최된 행사로서 그 전반적인 과정이 사용자의 지배나 관리를 받는 상태에 있었다고 봄이 상당하고, 그 과정에서 발생한 위 사고는 업무상 재해에 해당한다.

C. Sub-decision

Therefore, the instant disposition, which is based on the premise that the Plaintiff’s injury during the instant stable games did not constitute occupational accidents, should be revoked on the ground that it is unlawful.

3. Conclusion

The plaintiff's claim of this case is justified and it is so decided as per Disposition.
