Reasons
Punishment of the crime
[criminal record] On October 15, 2014, the Defendant was sentenced to a suspended sentence of six months for committing a special larceny at the Suwon District Court, and on April 22, 2015, on the 27th day of the same month, the sentence of the suspended sentence became effective upon being sentenced to eight months of imprisonment for an attempted larceny of night buildings at night and the judgment became final and conclusive, and on the 29th day of the same month, the parole was released on February 29, 2016 and the period of parole was expired on April 12, 2016.
【Criminal Facts】
1. Larceny;
A. At around 01:00 on October 17, 2016, the Defendant: (a) opened a door that was not set away for the victim D-owned vehicle owned by the victim D in front of the Suwon-si, Suwon-si; and (b) stolen the Defendant’s credit card of the National Bank owned by the victim with a single credit card, one driver’s license, one load-free card, one load-free card, one cash, 7,000 won.
B. On October 25, 2016, around 02:40, the Defendant opened a door that did not lock the victim E-learning passenger car at the apartment underground parking lot located within the border water of the Suwon-gu, Suwon-si, Suwon-si, and stolen the Defendant with one credit card of the company bank owned by the victim and one cash 10,000 won.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On October 17, 2016, the Defendant purchased goods equivalent to KRW 4,500 from the G convenience store located in Suwon-si F on KRW 02:04 on October 17, 2016, and received goods from the Defendant using the above national bank’s credit card on eight occasions in total as indicated in the list of crimes in the attached Table, including the receipt of goods by presenting the credit card completion of the stolen name D as his card to the victim H, as stated in paragraph 1(a).
Accordingly, the defendant used stolen credit cards, and received the total amount of 191,900 won by deceiving the victims.
B. On October 25, 2016, the Defendant: (a) around 03:01 on October 25, 201, 200 KRW 6,500,000, at the J convenience store located in Suwon-si, Suwon-si, Suwon-si.
