피고인은 2018. 3. 9. 08:28 경 부산 금정구 B 앞길에서 승용차를 운전 중이 던 피해자 C( 여, 41세) 의 차량 진행방향을 자신의 트럭으로 가로막고 피해자에게 대화를 시도하였으나, 피해 자가 위 차량 문을 열어 주지 않고 무시한다는 이유로 화가 나 위험한 물건인 철제 라 쳇 핸들( 총 길이 40cm )를 들고 차량 유리창을 찍을 듯이 들어 올린 상태로 수회에 걸쳐 “ 내려 라. ”라고 말하여 위협하였다.
