A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. From January to February 2018, 2018, the Defendant commits the crime from January 1 to February 2018.

2. 2018. 5. 26.경 범행 피고인은 2018. 5. 26. 15:30경 경주시 B 아파트에서, 피해자 D(여, 당시 15세)에게 F 메시지로 “사실 그 때 옥상에서 니랑 한 오빠거든 그 때 있었던 일 다른 애들한테 알려지기 싫으면 오늘 그냥 만나자 ㅋㅋ”라고 협박하여 이에 겁을 먹은 피해자를 불러내어 위 아파트 E동 옥상 입구로 데려가 피해자의 브래지어 속에 손을 넣어 피해자의 가슴을 만지고 피해자의 팬티 속에 손을 넣어 피해자의 질에 피고인의 손가락을 삽입하였으며, 싫다고 거부하는 피해자의 입에 피고인의 성기를 강제로 넣어 피해자로 하여금 이를 빨게 하였고, 마침 그곳에 살던 주민이 옥상으로 올라오자, 피해자를 G동 옥상으로 데리고 가 재차 피해자의 가슴과 음부를 만지고 손가락을 피해자의 성기에 삽입하고 피해자로 하여금 피고인의 성기를 빨게 하였다....
