A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 공무집행 방해 피고인은 2017. 2. 4. 02:10 경 부산 부산진구 C에 있는 “D” 앞 노상에서 이마에 피를 흘리며 쓰려 져 있던 중( 왜 피를 흘리고 있었는지 그 이유는 알 수 없다), 신고를 받고 현장에 출동한 119 구급 대원 및 부산진 경찰서 F 지구대 소속 경찰관 경위 G( 이하 ‘G 경위 ’라고 한다), 순경 H( 이하 ‘H 순경’ 이라 한다) 이 피고인을 구급차에 옮긴 후 병원으로 가서 치료를 받으라고 하자, 술에 취한 상태에서 H 순경에게 “ 야! 이 개새끼야!”, “ 이 씹할 놈이! 줘 때려 뿌까 ” 라는 등 욕설을 하면서 때릴 듯이 달려들고, 주변에 있던 구급 대원들과 G 경위가 피고인을 제지하는데도 계속해서 H 순경에게 달려들어 손과 몸으로 H 순경을 두 세 차례 밀치고, 이에 G 경위가 욕설을 하지 말고 병원에 가서 치료를 받으라고 재차 권함에도 주먹을 들고 G 경위를 때리려고 하면서 “ 쳐 발라 뿌까 이 개새끼야!”, “ 경찰! 지랄!” 이라고 욕설을 하고, 장 경위를 수차례 밀쳤다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers for 112 reporting operations.
