A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
From May 2016 to August 2016, the Defendant served as a "C agency located in Dobong-gu Seoul Metropolitan Government B" and performed a mobile phone opening.
[2017 Highest 3995] The Defendant, for the new opening of a mobile phone, opened an additional cell phone without the consent of D and laid it out to gain profits from the opening of a mobile phone.
1. Around July 4, 2016, the Defendant forged private documents: (a) stated “E in the column of the new subscription number of the site for the service contract kept there; (b) stated D’s name and date of birth in the column of the new subscription number; (c) stated “D’s name and signature in the column of the customer column of the application for subscription; and (d) stated D’s name and date of birth in the column of the customer information on the purchase of the site for short-term sales contract kept there; (d) stated “IPHON6S-64GR” and “1,062,80” in the column of the model name; and (d) stated “D’s signature on the next page; and (d) stated “36 months” and “5.9%” in the column of the frequency of the installment redemption contract that is kept there; and (d) stated “D’s signature in the column of the column of the application.”
Accordingly, for the purpose of uttering, the defendant has forged one copy of a new service contract in the name of D, one copy of a contract, and one copy of a installment repayment contract in the name of D, which is a private document concerning rights and obligations.
2. The Defendant: (a) sent a copy of a new service contract in the name of D forged at the time and place specified in paragraph (1); (b) one copy of a closed-end sales contract; and (c) one copy of a D’s welfare card which was kept in custody of a divided repayment contract; and (b) received from the person in charge of the victim’s company the delivery of one mobile phone of Aphone 60,062,80 won, which was opened in the name of D in the victim’s name.
