A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a university student who was engaged in volunteer service in the public book room operated by the Csung Party in Incheon City, and the victim D was a elementary school student who was enrolled in the above public book room and was friendly.

1. From July 9, 2011 to the following day, the Defendant committed a crime: (a) from July 9, 2011 to July 9, 2011, the Defendant stated that, at the home room of the Defendant’s home located in the Namdong-gu Incheon Metropolitan City E apartment, a computer game is being carried out; and (b) that, at the same time, the victim D (the age of 11 at that time, would buy game items) would be called “to buy game items”; (c) the victim’s flac, in the rear side of the victim’s hand, she was able to write down the victim’s chest with his clothes, and continue to read the victim.

Accordingly, the defendant committed an indecent act against the victim with knowledge that the victim is a person under the age of 13.

2. From July 16, 2011 to the following day, the Defendant committed a crime between July 16, 2011 and the following day, saying, “The Defendant will sell a game item” to the Defendant’s home room and play a computer game at the Defendant’s house, and that “the Defendant will sell the game item” to the Defendant. The Defendant continued to write down the victim’s chest with the Defendant’s hand in the lower part of the victim’s hand, and continued to read the victim’s clothes.

Accordingly, the defendant committed an indecent act against the victim with knowledge that the victim is a person under the age of 13.

3. From July 23, 2011 to the following day, the Defendant committed a crime between July 23, 2011 and the following day, saying, “The Defendant will sell a game item” to the Defendant’s home room and play a computer game at the Defendant’s house, and that “the Defendant will sell a game item” to the victim following the victim’s hand in the lower part, and the victim’s chest was able to write down and continue to read the victim’s clothes.

Accordingly, the defendant is the victim under 13 years of age.
