1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The defendant is a company established for the purpose of running a credit card business (hereinafter referred to as the "defendant company"), and the plaintiffs are those who retired after serving as the head of the claim management headquarters belonging to the defendant company.
B. A career improvement phase 1) On December 9, 2010, Defendant Company agreed to introduce a post-line system with a view to strengthening the human competitiveness and promoting the efficiency of human resources management, including the chief of the department assigned from among the labor unions of Defendant Company and the chief of the department subject to disciplinary action or the chief of the department, but having agreed to return to general duties or return to work in accordance with the results of a comprehensive evaluation reflecting the achievements and capabilities evaluation. (2) On November 18, 2013, Defendant Company agreed to change the name of the Defendant Company’s labor union and the post-line system to the career improvement phase, and to reduce other deliberation procedures and operating standards.
3) At the time, Plaintiff A was working as the head of the compliance supervision team of the Defendant Company, and Plaintiff B as the head of the Gangnam Branch of the Defendant Company. The Defendant Company, on December 11, 2013, as part of the entry into the first phase of career improvement as part of the agreement on the improvement of the above personnel system, issued a personnel order to the head of the Credit Management Headquarters affiliated with the Defendant Company (hereinafter “instant personnel order”).
(c) The Defendant Company held a desired retirement on December 2015.
According to the public notice of the Defendant Company’s voluntary retirement (hereinafter “instant public notice”), the Defendant Company’s voluntary retirement is required to pay children’s school expenses, health examination expenses, and subsidies for change of occupation and business start-up as special retirement allowances and welfare support for those who retire desired.
In the case of the head of a department, the criteria for granting special retirement allowances shall be ① A basic special retirement allowance: A monthly pay x 1.89 x 24 months, ② A special retirement allowance: six months after 62 years: and ③ The head of a department other than the head of a department shall be the special retirement allowance.
