A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On November 201, 201, the Defendant made a false statement to the effect that “The Defendant purchased and sold 1,000 dubine 1,00 from Hoju in Hoju, and left interest of KRW 100,000,000,” and that “The Defendant only purchased and sold dubine 1,000,000,000,000,000,000,000,000 won, from Australia, will be added to the principal and the profits within 2 months from the sale of the imported 10,00,000,000,000,000,000 won, to the victim’s office operated by the victim E in Gangnam-gu, Seoul.” The Defendant established a false statement to the effect that “The Defendant would have succeeded to the instant apartment property jointly with the Defendant’s parents in North Korea, and that it would immediately own it in G, and that it would immediately own it in G.”
However, the Defendant was not able to offer the above real estate to the victim as security because he did not own an apartment house in the G mountainous district or G, and the Defendant did not have an organizational network for the sales of double-matet and department stores. 2. On February 14, 2012, the Defendant: (a) received a demand from the victim E to provide a security to return or promise KRW 80 million received from the victim E at an unsound place; (b) the Defendant would create a collateral security right with respect to the mountainous district located in the border F.
