A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around June 4, 2014, the Defendant, on the victim C, posted a letter stating “The VIP card is sold on the Jeju Libera website” and made a false statement to the victim that the victim wishes to purchase.

However, the defendant did not have any intention or ability to send money even if he did not receive money from the victim due to the absence of the above card.

As such, the Defendant, by deceiving the victim, received 4,350,000 won from the victim to the Defendant’s new bank account on the same day.

2. On July 15, 2014, the Defendant, on the victim D, posted a false statement stating that “The Defendant sold 500,000 won merchandise coupons 50,000 won and two merchandise coupons 50,000 won to the new world merchandise coupon” on the website, and subsequently, the Defendant made a false statement to contact the victim that “The Defendant wishes to purchase 920,000 won or more to pay 920,000 won in the first place.”

However, there was no intention or ability to send money even if the defendant received money from the victim due to the absence of the above merchandise coupon.

The Defendant, by deceiving the victim as such, received 920,000 won from the Defendant’s agricultural bank account on the same day from the victim and fraudulently acquired it.

3. On July 14, 2014, the Defendant posted a false statement on the victim E’s website stating that “The Defendant shall sell 500,000 won merchandise coupons 50,000 won per head of the new world to 4.70,000 won per head of the 4.70,000 won.” The Defendant sent a false statement to the victim that the victim would wish to purchase, “The Defendant will send the money first to 90,000 won to 2,000 won as a registration.”

However, there was no intention or ability to send money even if the defendant received money from the victim due to the absence of the above merchandise coupon.

The Defendant, as such, deceiving the victim and deceiving the victim, shall be the Agricultural Cooperatives of the Defendant around July 16, 2014.
