A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. Around December 28, 2019, the Defendant violated the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Ameras, etc. of Specific Crimes) taken the form of the victim using a mobile phone owned by the Defendant (No. 1 and Samsung Ggalle S9) from among the Dos having a sexual intercourse with the view of the victim C (the age of 23) of a related party within the Bupyeong-gu Incheon Bupyeong-gu Btel on a 04:10 on December 28, 2019.

2. 특수협박 피고인은 같은 날 08:00경 위 장소에서, 성관계 영상을 촬영한 사실을 눈치 챈 위 피해자로부터 헤어지자는 말과 함께 집에서 나가달라는 요구를 받고 밖으로 나갔다가 다시 피해자의 집으로 찾아와 피해자와 대화를 하던 중 피해자로부터 헤어질 것을 요구받자 화가 나 주방에 있던 위험한 물건인 칼(칼날길이 약 16cm)을 들고 자신의 손목을 그으려고 하면서 “내가 칼로 죽어버릴거다, 내가 못할 것 같냐, 너 때문에 사람 죽는 거 영광인줄 알아”라고 말하면서 피해자가 자신과 헤어지면 자살하겠다고 하고, 피해자에게 칼로 위협을 당할지도 모른다는 공포심을 주는 등 피해자에게 해악을 가하였다.
