On the premise of fact, Defendant A Co., Ltd. (hereinafter “Defendant A”) following the implementation of the performance project (hereinafter “Defendant A”) aims at cultural events, performances, events, exhibitions-related projects, etc., and Defendant B’s limited liability company (hereinafter “Defendant B”) aims at producing and distributing performances.

피고들은 지휘자로 C를 캐스팅하고 D 감독의 연출로 2012. 11.경 일본 도쿄돔에서 오페라 E 공연을 개최하기로 하여 지휘자 등의 캐스팅과 도쿄돔의 대관비용 등으로 각기 10억 원을 투자하였다.

그러나 D 감독의 E 공연은 센카쿠 열도 등을 둘러싼 일본과 중국의 분쟁으로 인하여 취소되었고, 이에 피고들은 도쿄돔을 무대로 하는 오페라 F 공연을 대신하여 추진하면서 투자자를 물색하게 되었다.
