1. The Defendants are jointly and severally liable to the Plaintiff for KRW 34,103,736 and KRW 7,266,103 among them, from September 18, 2018, and KRW 26,837.

1. Facts of recognition;

A. The Plaintiff is an insurer who entered into a fire insurance contract (hereinafter “instant fire insurance contract”) with the F apartment council of occupants’ representatives and the insurance period from September 10, 2017 to September 10, 2018 with the F apartment unit of 594 households G G 7 Dong-dong 594 (hereinafter “F apartment”) in Chungcheong-si, Chungcheongnam-si, Chungcheong-si, and the household unit located within the said apartment building, compensating for the damage if the damage was caused by fire (hereinafter “instant fire insurance contract”). Defendant C Co., Ltd (the first company was “H Co., Ltd.”). On November 4, 2014, the trade name was changed to “F apartment Co., Ltd.” and was changed to the current trade name on June 28, 2019, and Defendant E Co., Ltd. (hereinafter “Defendant E”) concluded a kimchi liability insurance contract with the Defendant E Co., Ltd. as the insurer. (hereinafter “Defendant E”).

B. Nonparty J, who resides in the above F apartment I (hereinafter “instant apartment”), purchased and supplied a kimchi cooling house (a model name K; hereinafter “instant kimchi cooling house”) manufactured and supplied by Defendant C on June 2013, 2005, and installed and used it in the benda of the instant apartment.

C. On July 12, 2018, around 16:43, the apartment of this case started in the lower part of the lower part of the kimchi cooling ground, and the fire (hereinafter “instant fire”). The apartment of this case was destroyed by the fire, and the outer wall of the instant apartment of this case and the corridor wall, which is the section for common use, were destroyed by flame and dust, and the apartment of 9 households (Mhoho, Nho, Oho, P, Qhoho, Rho, Tho, Tho, U), which are located in the same line as the instant apartment, was partly damaged by the floor and height of the instant apartment.

As prescribed by the instant fire insurance contract, the Plaintiff’s total sum of KRW 14,532,207, and October 15, 2018, as the insurance money to the victims of the instant fire, as stipulated by the instant fire insurance contract.
