1. The Defendant shall pay to the Plaintiff KRW 35,513,349 and the interest rate of KRW 15% per annum from October 13, 2017 to the date of full payment.

The Plaintiff’s supply of oil equivalent to KRW 37,113,349 in total to the Defendant from May 2017 to August 2017 is without dispute between the parties, and the Plaintiff’s own recognition is that the Plaintiff was paid KRW 1,60,000 from the sales price of the automobile owned by the Defendant on November 28, 2017. According to the above recognition, the Defendant is obligated to pay to the Plaintiff the amount of KRW 35,513,349 (=37,113,349 - 1,60,000) and damages for delay calculated at the rate of KRW 15% per annum as the Plaintiff seeks.

In regard to this, the defendant defense that the defendant paid the above oil price, but there is no evidence to acknowledge it.

Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
