Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No person shall interfere with the execution of duties of railroad workers for the safety, protection of railroads and the maintenance of order due to violence or intimidation.

1. 피고인은 2015. 6. 24. 14:20 경 지하철 4호 선 4609호 오이도 행 하행선에 승차하여 상도 역까지 이동하던 중, 주변 시민들 이게 " 깜둥이랑 섹스 하지 마, 3년 후에 대 환란이 온다" 라며 승객들에게 불안감을 조성하고, 이에 서울 메트로 D과 소속 지하철 보안관 E, F가 출동하여 같은 날 14:53 경 피고인을 삼각지역에 하차시켜 역무실로 데려가려 하자 지하철 보안 관인 F의 양 팔뚝을 손톱으로 할퀴어 상처를 입히는 등 폭행하였다.

The facts constituting the crime described in the preceding paragraph reveal that E and other police officers arrested the Defendant as a current offender violating the Railroad Safety Act and carried the Defendant on the back seat of the patrol vehicle and escorted the Defendant to the back seat of the patrol vehicle, and assaulted the Defendant, such as taking one time the right edge of the subway security guards E, and taking the head of the said E once.

Accordingly, the defendant interfered with legitimate execution of duties of E and F, a railroad worker who performs crime prevention activities and maintenance of order within the jurisdiction of the government agency to which he belongs by assault or intimidation.
