Although examining the reasoning in light of the relevant statutes and the records, the lower court’s judgment, which found the Defendant guilty of the violation of the Narcotics Control Act and the violation of the Narcotics Control Act (marijuana) among the facts charged in the instant case on the grounds stated in its reasoning, did not err by misapprehending the legal doctrine on Article 62(1)3 of the Narcotics Control Act by violating the principle of prohibition of analogical interpretation, contrary to what is alleged in the ground of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
