Punishment of the crime

1. Defendant B, C, D, E, F, G, H, and J (the premise fact) was established on January 18, 1996 for the purpose of surveying business, waste disposal business, etc. and from around January 18, 2001, Defendant B’s director of L Co., Ltd. (hereinafter “L”) managing the X sewage treatment headquarters entrusted from X Gun (hereinafter “L”)’s above X sewage treatment business (the above business office takes charge of the management of Y public sewage treatment plant, Z public sewage treatment plant, and AA public sewage treatment plant, hereinafter “this case’s sewage treatment plant”), Defendant C is a general manager of the Y public sewage treatment plant (hereinafter “Y public sewage treatment plant”), Defendant C is a person who works for the head of the instant sewage treatment team, Defendant D, Defendant EF, Defendant G, Defendant G, Defendant H, Defendant H, Defendant I’s employee, and Defendant K, and Defendant C’s employee, respectively.

A person who operates a public sewage treatment facility shall install a measuring device, such as an automatic water quality measuring device (hereinafter referred to as "Tms"), in order to verify whether the water pollutants discharged meet the permissible discharge standards and criteria for effluent water quality, and shall not intentionally fail to operate the measuring device, or prevent the measuring device from operating normally.

On the final outlet of the sewage treatment plant of this case, Tms are attached to the final outlet of the sewage treatment plant of this case to analyze and measure the concentration of water pollutants by automatically collecting the specific quantity of the discharged sewage and automatically transmitting the large-scale measurement value per hour to the Korea Environment Corporation and the Korea Environment Corporation. The Korea Environment Corporation has used the measurement value transmitted as above as administrative data to determine whether the water pollutants concentration in sewage discharged from the sewage treatment plant of this case exceeds the permissible discharge level by deeming the measured value as the water pollutants concentration in the sewage discharged from the sewage treatment plant of this case.
