The appeal is dismissed.

The grounds of appeal are examined.

For the reasons indicated in its reasoning, the lower court upheld the first instance judgment convicting the Defendant of the instant facts charged, on the ground that there is sufficient evidence to prove the criminal intent of the Defendant’s deception and the prosecutor’s deception against the victim.

Examining the record in accordance with the relevant legal principles and evidence duly admitted, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or by misapprehending the legal principles on the standard point of determining the crime of deception and the method of determining the other party of deception.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
